Usage Calendar
Paris is alluring anytime of the year. Yet some prefer the summer months while others want to spend the holidays with friends and family in the City of Lights. 7 Rue Malher offers three usage options combining floating and fixed weeks that allow each purchaser to choose the schedule best suited to his or her needs. Each share comes with 4 weeks of usage each year.

With any option, fractional owners can trade weeks with their co-owners, or allow guests to use the apartment.

Fully Floating: Fractional owners who choose the Fully Floating option enjoy the property for two 2-week periods each year based upon an automatic seasonal rotation system. This means that one year an owner will have Fall and Spring, and the next year, Summer and Winter. The rotation schedule is defined at the outset, allowing total clarity into your usage in perpetuity. The calendar is designed to maintain a proportional number of floating weeks during each season.

Fixed + Floating: Fractional owners may choose two specific weeks which are permanently reserved for their use. They then participate in the Floating system for their remaining two weeks. This option guarantees owners usage during their favorite time of year, yet also allows them to discover Paris at other times. This is our most popular option.

Fully Fixed: Fractional owners who plan to visit Paris at the same times every year may choose specific calendar weeks that are reserved for them permanently. For example, a purchaser might select two weeks in early May and two weeks in late September. Fixed weeks are reserved on a first-come, first-served basis

Regardless of the option chosen, fractional owners retain the flexibility to trade weeks with other co-owners or to allow relatives and guests to use the apartment.

Week 1 includes January 1. Weeks begin on Saturday & are sold in 2-week increments. Weeks not purchased as fixed weeks will be added to the floating pool.
7 Rue Malher reserves the right to make minor adjustments to the calendar to ensure fairness to all owners.

Legal Structure
The apartment will be acquired via a 12-member homeowners association (HOA) formed under California law.
The HOA will own a French corporation (SCI), which in turn will own the property.
The rights and duties of each co-owner will be defined in the HOA agreement, which is governed and enforceable under US law.
Co-owners may sell, gift or will their shares at any time in accordance with US law, thus avoiding the intricacies of a French real estate transaction.


Management & Dues
The property will be professionally managed by a specialized Paris-based property management firm.
The Manager’s responsibilities will include preparing the annual budget, housekeeping and maintenance, and concierge services.
The associated costs for these services will be incorporated into the operating budget and shared equally by all owners.
The contract with the management firm will be renewed on an annual basis. Co-owners have the right to discontinue the management agreement if they so desire.
